Wide Satisfaction in Sharjah on the Approve the Draft Law of Domestic Servants

A number of citizens and residents expressed their hope that the draft law of assistance workers, approved by the Federal National Council recently put an end to the problems they have suffered with a class of domestic servants over the past years, some of them escaping to the legitimate labor market, and many of them refused to work, without good reasons, after their testing period, in addition to other miscellaneous problems.

The draft law set 19 profession subject to the provisions of this project, the Council amended the title of Article three from "Labor Exchange Bureaus" to “Employment Agencies”, because of the amendment named in the material definitions have been modified in this place, to standardized terminology, the Council introduced a condition of granting the license to citizen manager with good conduct and behavior certificate, and providing a bank guarantee as determined by the executive regulations of this law.

Also the project was approved by the Federal National Council is the culmination of the march of the state in the field of human rights, as its provisions stemming from the legal principles and rules, which take into account the foundations of conventions and the international obligations assumed by the State, this was confirmed by Mohammed Abdullah AlJowder Executive Director of “Patients Friends” Committee in Sharjah, he said in his speech: "The draft law is an important achievement to reduce the cases of servants and conflicts between them and the sponsors, especially that in the past there was no legal and clear texts on many issues in this category, which was referred to the judiciary after the administration of disputes exhausted all solutions have to find a settlement.

For his part, Dr. Faisal Shaheen, director of the Center examination of foreign workers in the Fifth industrial area in Sharjah, stressed that the problems of domestic workers, including domestic servants, special drivers, farmers and similar workers that suffered by both parties "sponsors and sponsored" throughout the past years, was due to the absence of many of clear provisions in the contractual relationship, and there is no doubt that it will witness a major breakthrough through the project to help the Employment Act passed by the National Council recently.

The law will impact its positive and effects on the stability of families and domestic workers in various categories, this is confirmed by Dr. Azza Mustafa Abu Al-Ula, a specialist psychiatric treatment, she added: the draft law identified the responsibilities of offices to bring in domestic workers, including not allowing them to bring in workers from their countries, only after inform them of the type of work, nature and amount of remuneration, and provide proof of their fitness and their health status psychological and occupational and other conditions specified by the regulations of this law.

Abdullah AlHammadi, Head of Public Relations in Sharjah Charity Association, pointed out that the draft law will organize the relationship of the assistance service workers with the owners of the business, and the relationship of these two categories with the broker offices, through the identification of occupations subject to the provisions of the draft law, the obligations of the parties and determine their relations in accordance with articles of the draft law, and this would preserve the rights of the parties.

Yousuf AlZarouni, a businessman, said that the law of the new assistance service workers will organize the working mechanism between the employer and the worker, and eliminates the previous negative aspects and guarantees the rights of domestic workers, and the similar workers, arising from the employer, as well as the rights of employers of domestic workers, and he noted that this law will eliminate any previous negative aspects, such as escaping and non-payment of remuneration and other problems.

With respect to disputes between servants and sponsored, Aisha Abdullah, a teacher, she noted that some of them was not always where the sponsor is the victim, but he is responsible at least in part on the escape these workers, as a result of poor-treatment or waste of the rights of this category, in terms of non-payment of salaries, or cutting off part of it, or even the failure to provide housing and proper treatment, she added: from this point the draft law will preserve the rights of the parties, and this in itself is emphasis on respect for the state to labor rights.
